    (二)甲方的義務(wù)
    1、按照有關(guān)勞動(dòng)安全、勞動(dòng)保護(hù)、職業(yè)安全衛(wèi)生的規(guī)定,向乙方提供必需的生產(chǎn)(工作)條件;
    2、創(chuàng)造條件提高乙方的政治思想素質(zhì)和業(yè)務(wù)技術(shù)水平;
    3、根據(jù)有關(guān)規(guī)定及本合同有關(guān)條款,按時(shí)支付乙方勞動(dòng)報(bào)酬并提供保險(xiǎn)福利待遇;
    4、向乙方提供符合國家規(guī)定的勞動(dòng)安全衛(wèi)生條件和必要的勞動(dòng)防護(hù)用品;
5、雙方約定的其他義務(wù):
    (三)乙方的權(quán)利
    1、享有參加業(yè)務(wù)(技術(shù))學(xué)習(xí)(培訓(xùn))、參加工會(huì)、參與民主管理和提出合理化建議、評(píng)選和被評(píng)選為先進(jìn)職工(生產(chǎn)者)等權(quán)利;
    2、按照規(guī)定領(lǐng)取勞動(dòng)報(bào)酬和享受勞動(dòng)保險(xiǎn)福利待遇;
    3、享有休息、休假與獲得勞動(dòng)安全衛(wèi)生保護(hù)的權(quán)利。對(duì)違章指揮、強(qiáng)令冒險(xiǎn)作業(yè),有權(quán)拒絕執(zhí)行;

4、努力學(xué)習(xí)政治文化知識(shí),刻苦鉆研技術(shù),不斷提高專業(yè)技術(shù)水平,積極參加必要的
社會(huì)活動(dòng);從事技術(shù)工種或崗位的,上崗前必須接受培訓(xùn);

    四、工作時(shí)間與勞動(dòng)報(bào)酬
    (一)甲方根據(jù)國家法律、法規(guī)和本單位生產(chǎn)(工作)實(shí)際,實(shí)行   工作制。甲方對(duì)乙方實(shí)行每日工作時(shí)間    小時(shí),平均每周工作時(shí)間    小時(shí)的工時(shí)制度

。甲方確需乙方加班加點(diǎn)時(shí),在征得工會(huì)和乙方同意后,一般每日不超過1小時(shí),每月累計(jì)不得超過36小時(shí),并按有關(guān)規(guī)定支付加班費(fèi)或調(diào)休。
    (二)勞動(dòng)報(bào)酬
    1、乙方完成本合同規(guī)定的生產(chǎn)(工作)任務(wù),甲方應(yīng)以貨幣形式每    (月、周、日)按    元支付給乙方工資,支付時(shí)間為    ;

(一)甲乙雙方必須依法參加社會(huì)保險(xiǎn),甲方按所在地規(guī)定的一定比例按月為乙方交納養(yǎng)老、醫(yī)療、工傷、失業(yè)、生育保險(xiǎn)費(fèi),乙方個(gè)人負(fù)擔(dān)的部分,由甲方代

    六、勞動(dòng)合同的變更、續(xù)訂、解除及終止
    (一)下列情況,甲乙雙方可以變更本合同的相關(guān)內(nèi)容
    1、甲方轉(zhuǎn)產(chǎn)或調(diào)整生產(chǎn)任務(wù)的;
    2、甲乙雙方協(xié)商同意,并且不損害國家和集體利益的;
    3、由于不可抗拒力致使本合同無法履行的;
4、雙方約定的其他情況:
    (二)在下列情況下,甲方可以解除勞動(dòng)合同
    1、在試用期內(nèi)證明乙方不符合錄用條件的;
    2、乙方違反或不履行勞動(dòng)合同的;
    3、乙方嚴(yán)重失職,營私舞弊,對(duì)甲方利益造成重大損害的;
    4、乙方嚴(yán)重違反勞動(dòng)紀(jì)律或甲方規(guī)章制度,泄漏甲方商業(yè)秘密的;
    5、乙方被依法追究刑事責(zé)任的;
6、乙方患病或者非因工負(fù)傷,醫(yī)療期滿后不能從事原工作,也不能從事由甲
方另行安排的工作的;
    7、乙方不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;
8、勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使原勞動(dòng)合同無法履行,經(jīng)甲、乙雙方協(xié)商不能就變更勞動(dòng)合同達(dá)成協(xié)議的;
9、經(jīng)有關(guān)部門確認(rèn),甲方歇業(yè)或合營、合資期滿關(guān)閉,宣告破產(chǎn)或者瀕臨破產(chǎn)處于法定整頓期間的;依照第6、7、8、9條解除勞動(dòng)合同的,甲方應(yīng)提前三十日

以書面形式通知乙方并支付經(jīng)濟(jì)補(bǔ)償金。
10、雙方約定的其他情況:
    (三)在下列情況下,甲方不得解除勞動(dòng)合同
    1、勞動(dòng)合同期未滿,又不符合上款解除合同條件的;
    2、乙方患職業(yè)病或者因工傷殘并被勞動(dòng)鑒定委員會(huì)確認(rèn)為喪失或者部分喪失勞動(dòng)能力的;
    3、乙方患病或者負(fù)傷,在規(guī)定醫(yī)療期內(nèi)的;

    5、乙方在享受法定休假、探親假期間的;

    5、甲方有侵害乙方合法權(quán)益行為的;
    6、經(jīng)甲方同意,乙方自費(fèi)離職學(xué)習(xí)和培訓(xùn)的;
7、乙方參軍、入學(xué)或出境定居的:

    (五)在下列情況下,乙方不得解除勞動(dòng)合同

4. Working hours and labour remuneration

5. Social insurance and welfare

6. Labor contract's changes, the renewal, removal and termination
(一) Both sides can change this contract related contents if the following situations appear:
A. The first party transfer the production or adjust the production tasks.
B. Both sides agree and it do not hurt he state and group's benefits.
C. The contract can not reach because of irresistibility.
D. Other situations appointed by both sides:

A. The second party can not reach the employ conditions.
B. The second party violate or do not comply with the terms of the labour contract.
C. The second party is out of duty seriously, with malpractice and hurt the benefits of the first party seriously.
D. The second party seriously violates labor disciplines or the rules and regulations of the first party , and leak the first party's

commercial secrets.
E. The second party is investigated for criminal liabilities according to law.
6. The second party is sick or not be injured at work,and cannot be engaged other work by the firat party after the expiration of the

medical treatment.
7. The second party can not be qualified for th job, or still not qualified for the job after training or job adjustment.
8. The objective circumstances has changed which was the base of the labour contract. So that the contract can not fulfilled, and it can

not reach an agreement after consultation by both sides.
9. Confirmed by the relevant departments, party a go out of business or joint venture, the joint venture expires closed, declares

bankruptcy or on the verge of bankruptcy during the period of statutory consolidation; In accordance with the 6, 7, 8, 9 the removal of

partial loss of working ability.
C. The second party get sick or hurt seriously during the period.
D. Female worker is in pregnancy, produce period or lactation
E. The second party are enjoying the legal holiday or in the family visit.
F. Other situations regulated by the laws and regulations.
G. Other situations appointed by both sides

(四) The second party can remove the labour contract under the following situations.
A. During the probation
B. The first party compel labour with the methods of violence, threat or illegal restriction of personal freedom
C. The first party do not pay the labor remuneration or insurance and welfare treatment according to the national, provincial and the

contract.
D. The first party owns bad condition of the labour safety and the health condition, and hurt the employees' health badly.
E. The first party's performance has hurt the legal benefits of the second party.
F. Agreed by the first party, the second party resigned and trained by himself/herself.
G. The second party join the army, entrance or go abroad to settle.
H. Other situations appointed by both sides

 (五)The second party must not remove the labour contact under the following situations.
A.  Accept training  (including send large, secondary technical schools or vestibule school learning) capital contributed by the first

party, and service for the first party under____years after training.
B. Belongs to the technical backbone, to undertake a key project construction, reconstruction task or scientific research projects and task

unclosed.
C. Other situations appointed by both sides  
7. The responsibilities about violating violateing the contarct
